is not ross mirkarimi, it's not george gascone. it's the hundreds and thousands of victims and their families impacted every day. women's are suffering in silence. and there has been unfortunately in the last few months in this city, a setback because of the way that one individual has elected to handle his own personal shortcomings. let's be really clear here. there is only one person that committed a crime here, it's ross mirkarimi. george gascone did not abuse his wife. ed lee did not abuse his wife. ross mirkarimi did. we have a really horrible situation here. we have a high position, law enforcement officer, who committed a crime. then denied that a crime had been committed. then tried to mitigate his actions. then tried to blame others. and then put together a whole campaign to go after anybody that called it what it was, a crime. so, what is not being talked about here is the victims. the mayor indicated [speaker not understood]. we have had a surge in reports of domestic violence-related incidents. we've got women every day that are suffering in silence. we know how difficult it is fo

the bas ofthe creek but there was no sign of the man. this all began after midnight when ross police made a dui stop on the man's car near sir francis drake and college. but during the field sobriety test, this man took off running from officers. officers watched him go in the creek and eventually lost sight of him. >> they followed for about 100 yards trying to encourage the person to come out of the swift water. he swam away from the officers. the officers followed him as far as they could until they couldn't anymore. >> reporter: now, the ross police chief said he isn't going to release the name of the missing man at this point but police are very concerned about his well being since the water is cold and the current, especially in the air area where he went in, is -- in the area where he went in, is swift. it's possible a dive team could be called in to search for him. but we understand the search- and-rescue team will pick up the search at 7:00, the chief said. we have not seen them yet. we'll monitor the situation. we're live in green brain -- greenbrae this morning, alex savidge, k

of highway 1 is closed because of a rock slide. it hit the road between fort ross and meyers grade roads just north of generaller there. you can see it on the map. the debris is gone, but you can see the damage to highway 1. a small section has collapsed. cal trans hopes to have the road open again by noontime tomorrow. >>> more road troubles. there is progress, but still a long way to go in the effort to repair a massive sinkhole in love lafayette, and now they are facing a sinkhole of their own. alan wang is live where storm repairs are well underway. >> reporter: the ground is mushy out hoar tonight, but the coming dry weather should give crews a chance to start rebuilding this washed out road. it will also give everyone a chance to start cleaning up. there is plenty of work to be done as the bay area starts to dry out. it took all day just to trim down the valley oak tree that fell on a home in lafayette. the tree cutters will be back tomorrow. utility and construction crews will be back on mountain view drive that collapsed on sunday night. several utility lines were snapped after debris

1238 and the town of ross. they pulled over a suspected drunken driver. when they were giving the sobriety test to the suspect he took off 01 feet and just over a fence. he it and jumped into this creek. they were able to have visual contact with their flashlights but they try to encourage him to get out of the water and that of merely they lost contact with him. they called other agencies to come out to help the mob.them out. >> they searched until about 430 this morning looking for any signs of the suspect. they could not find anything so that suspended the search. if they come back at daybreak to continue the search. so far they do not have any informational. this is where the command post was an obviously as this case and developing we will pass on any new information that we did. right now, we are waiting for search and rescue to come out here and start searching the creek again. >> authorities say they responded to a call of shots fired in the 700 block of market street around 830 last night. when they arrived, officers on an adult males suffer from a gunshot wound. that

and welcome to "squawk box" here on cnbc. i'm andrew ross sorkin along with joe kernen. becky continues to have the day off today. our guest host today is bob broska. house speaker john boehner urging the senate to come up with a passable fiscal cliff solution. he's promising to at least consider any bill that the upper chamber produces. senate majority leader harry reid now expected to base any legislation on a bill passed earlier this year to continue tax breaks for households will incomes below $250,000. a senate bill would likely contain an extension of expiring unemployment benefits. and the other big news of the morning, treasury secretary tim geithner unveiling a plan to buy time under the debt ceiling. in a letter to congress, geithner saying that treasury is going to begin taking steps this week to delay hitting the government's 16$16.4 trillion borrowing limit. treasury will take several measures to save that next year to keep the government from reaching the limit for about two months. but geithner warns it is harder to predict how long the delay will last because of all of t

the storm. the ross valley sanitary district blaimz it on a clogged sewer line. some 20,000 gallons washed in the local creeks and streams. >> students will be back in class tomorrow in a marin county middle school closed today because of storm damage. a building in white hall middle school took significant damage when a culvert backed up, flooding four classrooms. the library and administrative offices were flooded. >> anticipating flooring replaced depending on what the damage is. we may need to remove furniture. it's attached to the wall. >> 620 students attend this school. >> from floods to fallen trees people are digging out from the mess. this huge pine tree came crashing down from across the street. a neighbor managed to turn that off. homeowner still without gas but says the city was quick to help with clean up. >> there is where they had been working almost 24 hours. here they cleaned up and were very professional. >> clean up crews have been busy in almost every part of the bay area from fences and streets in san francisco to golden gate park officials were removing fallen trees.
